Acceptance of these Terms is required for charter booking or accessing our Service. If you do not consent to any part of these terms, you are prohibited from using the Service.

2. Service Overview

Our offerings at QuietRiverForge include a range of premium yacht lease services, such as:

• Daytime yacht rentals
• Evening sailing experiences
• Business getaways
• Exclusive celebrations
• Extended charter journeys

Availability and weather conditions may affect service delivery. We have the right to alter or discontinue services as necessary.

3. Booking and Reservations

3.1 Booking Process

Booking procedures include:

• Minimum age requirement of 18 years
• Provision of accurate and complete details
• Initial deposit payment as indicated in your booking confirmation
• Adherence to these Terms & Conditions

3.2 Confirmation

A booking is verified only after receiving your payment and issuing our formal confirmation. We maintain discretionary rights to decline service to any individual.

3.3 Availability

Charters rely on the vessel's availability and appropriate weather conditions. We strive to fulfill requests for preferred dates and timing.

4. Payment Terms

4.1 Pricing

Prices are provided in €, encompassing all relevant taxes unless stated otherwise. Price changes may happen without prior notice.

4.2 Payment Schedule

• Deposit: A 50% payment of the overall charter cost required at the time of booking
• Balance: Payable 48 hours in advance of the charter commencement
• Extra charges (when applicable): Payable upon the charter's conclusion

4.3 Payment Methods

Our accepted methods of payment include major credit cards, wire transfers, and certified bank drafts. We conduct payment processing through secure and encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With more than 72 hours before departure: Full refund excluding processing costs
• Between 24-72 hours before departure: 50% of the paid amount is refundable
• Less than 24 hours before departure: Non-refundable

5.2 Weather Cancellations

Should unsafe weather be determined by our captain, we will suggest:

• Rescheduling your charter without extra charges on the earliest available date
• Issuing a full refund in case rescheduling is not feasible

5.3 Mechanical Issues

If mechanical difficulties arise with the designated yacht, we will strive to offer an acceptable replacement. If substitutions are unavailable, we will reimburse fully.

6. Safety and Conduct

6.1 Safety Requirements

All voyagers are mandated to:

• Adhere to directives from the crew
• Utilize the provided safety equipment when required
• Notify of medical conditions potentially impacting their safety
• Stay within the vessel's designated zones

6.2 Prohibited Items

The list of items not allowed on board includes:

• Glassware
• Illegal materials
• Firearms or other weaponry
• Excess beverages beyond moderate consumption
• Pets (without prior approval)

6.3 Conduct

Passenger behavior must be courteous and respectful. A charter may be terminated prematurely and sans refund if a passenger's conduct endangers safety or disrupts others.

7. Liability and Insurance

7.1 Our Liability

We're only liable up to the chartered amount. Our responsibilities do not extend to:

• Injuries due to passengers' carelessness
• Theft or destruction of personal effects
• Non-direct, consequential, or punitive damages
• Delays from weather or situations beyond our control

7.2 Insurance Coverage

We carry extensive marine insurance for our vessels and operations. Passengers must ensure their own travel and personal insurance.

7.3 Assumption of Risk

Engaging in our charter services implies recognizing inherent risks associated with maritime activities and accepting responsibility for your own protection and welfare.

8. Modifications and Itinerary Changes

We may amend itineraries, paths, or timetables in response to meteorological conditions, safety needs, or operational mandate. We will make every effort to offer suitable alternative experiences.

9. Force Majeure

Our company is not responsible for postponements, cancellations, or alterations resulting from uncontrollable circumstances, which include, but are not limited to:

• Extreme weather occurrences
• Acts of nature
• Governmental decrees
• Harbor closures
• Vehicular malfunctions

10. Privacy and Data Protection

The confidentiality of your data is upheld according to our Privacy Policy. By utilizing our offerings, you consent to information collection and employment as detailed in our Privacy Policy.

11. Intellectual Property

Intellectual assets on our site, like texts, visuals, symbols, and photos, are guarded by copyright and brand laws. Without our express consent, no reproductions, distributions, or derivative works are authorized.

12. Governing Law

Applicable Germany laws govern these Terms. Disputes, if any, are settled in courts situated within Hamburg, Germany.
